TERMS AND CONDITIONS OF SALE - ANGEL FOOD
1. General information

2. Subject of the contract
These Terms and Conditions govern the sale of food products through this website.
The products are intended for human consumption and must be stored and used according to the instructions provided.
3. Acceptance of terms
By placing an order, the customer confirms that they:
- have read and understood these Terms and Conditions
- accept them in full without reservation
- accept the Privacy Policy
- accept the Cookie Policy
- accept the Return and Refund Policy
4. Prices and availability
- All prices are expressed in Euro (unless otherwise stated)
- Prices may be changed at any time without notice
- Product availability is not guaranteed until order confirmation
5. Contract formation
The sales contract is considered concluded when the customer receives order confirmation.
We reserve the right to refuse or cancel orders in case of:
- suspected fraud
- obvious pricing errors
- payment issues
6. Payments
Accepted payment methods include:
- Shopify Payments
- Stripe
- PayPal
- other methods shown at checkout
Payment is required in order to process the order.
7. Shipping, delivery and customs duties
Shipping times are indicative and may vary depending on carrier and destination.
We are not responsible for delays caused by:
- shipping carriers
- customs checks
- external events
- force majeure
7.1 Risk of transport
The risk of loss or damage passes to the customer at the time of delivery of the goods to the carrier appointed for shipment, except where mandatory consumer protection laws provide otherwise.
Any shipping insurance does not affect the transfer of risk and is used solely for handling insurance claims.
7.2 International shipping and customs
For orders placed outside the European Union, any:
- customs duties
- import taxes
- local VAT
- customs clearance fees
- other charges imposed by the destination country
are fully borne by the customer and are not included in the product price or shipping costs.
Failure to pay such charges may result in non-delivery of the goods, with application of the Refusal of Delivery policy.
8. Non-delivery, refusal and uncollected shipments
The customer is responsible for ensuring proper receipt of the shipment.
If the customer:
- refuses delivery
- fails to collect the parcel
- is absent or unreachable
the following conditions apply:
8.1 Implicit withdrawal
Such behavior is considered an implicit withdrawal from the purchase.
8.2 Handling of goods
The shipment may be:
- returned to sender
- held at the carrier’s facility
- destroyed for hygiene and safety reasons (food products)
8.3 Refund
A refund of the product price is subject to the following conditions:
- goods must be recovered intact
- goods must be suitable for inspection and logistics handling
If goods:
- are not recoverable
- are damaged
- are destroyed
- are no longer resellable
👉 the refund may be reduced up to zero.
8.4 Costs borne by the customer
The customer expressly agrees that the following costs are always non-refundable and borne by the customer:
- initial shipping costs
- return shipping costs
- storage fees charged by carriers
- administrative and handling costs
- disposal or destruction costs (if applicable)
In many cases, these costs may equal or exceed the order value.
9. Right of withdrawal (EU customers)
In accordance with EU law, consumers have the right to withdraw within 14 days of delivery.
Exceptions (food products)
The right of withdrawal does not apply or is lost in the following cases:
- opened products
- perishable or food items that are no longer resellable for hygiene reasons
- products that cannot be returned for health and safety reasons
10. Returns
Returns are only accepted if:
- previously authorized
- unopened, unused, and in perfect condition
- in original packaging
Return shipping costs are borne by the customer.
Unauthorized returns will not be accepted.
11. Refunds
Refunds are issued only after inspection of returned goods.
If approved:
- within 10 business days
- via the original payment method
Processing times depend on the banking institution.
12. Damaged or incorrect items
In case of:
- damaged product
- shipping error
- non-conforming item
the customer must immediately contact info@angelfood.it with photographic evidence.
If confirmed:
- replacement or full refund will be issued at no additional cost
13. Liability
We are not responsible for:
- improper use of products
- incorrect storage
- delays not directly attributable to us
- force majeure events
Maximum liability is limited to the order value.
14. Transactions and fraud prevention
The customer agrees that:
- payments may be subject to fraud screening
- we reserve the right to cancel suspicious orders
- data may be used for fraud prevention and dispute handling (Stripe/PayPal)
15. International customers (USA and non-EU countries)
For orders outside the European Union:
- no statutory right of withdrawal applies
- all claims are governed exclusively by this policy
- shipping, return, and logistics costs are always borne by the customer
16. Intellectual property
All website content is protected by copyright and may not be used without authorization.
17. Governing law and jurisdiction
These Terms are governed by Italian law.
For EU consumers, mandatory consumer protection laws of their country of residence apply.
18. Changes
We reserve the right to modify these Terms and Conditions at any time.
